Terms of Service

The rules for using MyBeachApp, including purchases, disclaimers and your rights.

This document is provided in English for your convenience. The English and Greek versions are the authoritative texts; for consumers resident in Greece the Greek version prevails in case of any discrepancy.

These Terms of Service ("Terms") form a binding agreement between you and Breukers Willem Albertus E.E. ("we", "us") governing your use of the MyBeachApp application and website (the "Service"). Please read them together with our Privacy Policy and Cookie Policy.

By downloading, accessing or using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1. Who we are

The Service is provided by Breukers Willem Albertus E.E., Valaoritou 1, 106 71 Athens, Greece (Γ.Ε.ΜΗ. 186520701000, VAT EL802973201). You can contact us at [email protected]. Full provider details are in our Legal Notice.

2. What the Service does

MyBeachApp helps you discover beaches on the Greek coast and shows an indicative "Suitability Score" that blends live weather and marine forecasts with coastline geometry and your stated preferences (such as wind, waves, sea temperature and sun).

The Service works without an account: your favourites and preferences are stored on your device.

3. Important safety notice — informational use only

The Suitability Score and all forecasts are provided for general information and convenience only. They are estimates based on third-party data and are not a guarantee of actual conditions, and they are not safety, navigational, medical or emergency advice.

Sea and weather conditions can change quickly and can be dangerous. Always use your own judgement and follow official information on the spot — lifeguards, beach flags, and warnings from local and coastguard authorities. Never rely on the Service to decide whether it is safe to swim, dive or undertake any water activity. You are solely responsible for your own safety and that of those in your care.

4. Eligibility and age

The Service is intended for a general audience and is not directed at children. You must be at least 15 years old — the age of digital consent in Greece under Law 4624/2019 — to use the Service. If you are under 18, you should use the Service only with the involvement and consent of a parent or guardian.

5. Acceptable use

When using the Service, you agree not to:

  • use the Service in any unlawful way or for any unlawful purpose;
  • copy, scrape, harvest or systematically extract data or content except as permitted by the underlying data licences;
  • interfere with, overload, or attempt to gain unauthorised access to the Service or its infrastructure;
  • reverse engineer, decompile or attempt to derive source code, except to the extent this restriction is prohibited by mandatory law;
  • remove or obscure any proprietary notices, or resell or commercially exploit the Service without our written permission.

6. Purchases and the ad-free upgrade

The Service is free to use and supported by advertising. You may make an optional one-time in-app purchase, "Ad-free lifetime", for €2.99 (or the local-currency equivalent shown at purchase), which permanently removes advertising. This is a one-time payment, not a subscription — there are no recurring charges.

All purchases are processed by the app store from which you downloaded the Service (Apple App Store or Google Play) under that store's own terms and payment methods. We use RevenueCat, Inc. to manage and validate entitlements. The store is the merchant of record for the transaction; final prices and applicable VAT are shown before you confirm.

Right of withdrawal for digital content

The ad-free upgrade is digital content supplied without a tangible medium. Under Article 16(m) of the Consumer Rights Directive 2011/83/EU (as transposed into Greek Law 2251/1994), by completing the purchase you expressly request that we begin performance immediately and acknowledge that you thereby lose your 14-day right of withdrawal once performance has begun.

This does not affect your statutory rights. If the digital content is faulty or not as described, you are entitled to a remedy under the Digital Content Directive (EU) 2019/770 as transposed into Greek law. Refund requests are handled by the relevant app store according to its refund policy; you may also contact us and we will assist.

7. Advertising

Unless you have purchased the ad-free upgrade, the Service displays advertising, including an optional "rewarded" ad that grants a temporary (24-hour) ad-free experience. Advertising is delivered through Google AdMob. Where the law requires consent for personalised advertising, ads are personalised only with your consent, which you can give or withdraw at any time; see our Cookie Policy and Privacy Policy.

8. Intellectual property and licence to you

We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the Service for your own non-commercial purposes, subject to these Terms. All rights not expressly granted are reserved. The Service uses third-party and open data (including OpenStreetMap, Open-Meteo and Google) under the licences described in our Legal Notice.

9. Third-party services and links

The Service integrates and links to third-party services (for example, your device's maps app for directions, the app stores, and data providers). We do not control those services and are not responsible for their content, availability or practices. Your use of them is governed by their own terms and privacy policies.

10. Availability and changes

We aim to keep the Service available and accurate but provide it on an "as available" basis. We may update, change or discontinue features, and may suspend the Service for maintenance or for legal or security reasons. We will give reasonable notice of material changes where practicable.

11. Disclaimers

To the fullest extent permitted by law, the Service and its data are provided "as is" and "as available", without warranties of any kind, whether express or implied, including as to accuracy, reliability, fitness for a particular purpose, or uninterrupted operation. Forecasts and scores are inherently uncertain.

Nothing in these Terms limits the statutory rights you have as a consumer, which cannot be excluded or restricted by contract.

12. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential loss, or for loss arising from your reliance on forecasts, scores or third-party data. Our aggregate liability arising out of or in connection with the Service is limited to the amount you paid us (if any) in the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under applicable mandatory law, including Greek consumer-protection law.

13. Suspension and termination

You may stop using the Service at any time by uninstalling the app. We may suspend or terminate your access if you materially breach these Terms or where required by law. Provisions that by their nature should survive termination (such as intellectual property, disclaimers and limitation of liability) will continue to apply.

14. Governing law and dispute resolution

These Terms are governed by the laws of Greece. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer-protection provisions of the country where you habitually reside.

We would like to resolve any dispute amicably first, so please contact us at [email protected]. If we cannot resolve it, you may refer the matter to the Hellenic Consumer Ombudsman (Συνήγορος του Καταναλωτή) (https://www.synigoroskatanaloti.gr) or to the competent alternative dispute resolution body in your country. The courts of Athens, Greece have jurisdiction, without prejudice to any mandatory right you have as a consumer to bring proceedings in, or be sued only in, the courts of your country of residence.

The EU Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025 and can no longer be used.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
